Curaçao – Amendment to the Expatriate Regulation

As of February 1, 2025, an amendment to the Ministerial Regulation expatriates will take effect. Employers hiring expatriates will be required to ensure that, within one year of employment, the expat trains a locally registered employee. This is intended to allow the local employee to take over the expat’s role after five years. Additionally, the possibility of extending expat status beyond five years will be eliminated. With this change, the government aims to increase job opportunities for locally registered residents of Curaçao.

What is the expatriate regime again?

The expatriate regulation provides tax benefits for qualifying foreign employees with specific expertise who come to work in Curaçao. Key advantages include the absence of grossing up in the case of a net salary agreement and the ability to provide certain tax-free allowances to expatriates. Specific conditions apply, including a minimum salary requirement.
